After successful Trademark Registration your trademark will be secured from10 years. After expiry of 10 years you are required to renew it. This is done because over time a lot of industrial changes happen a lot of new businesses boom in that time phase.
The intellectual property rights holder of a trademark is required to keep a vigilant approach and submit a renewal application before the expiry of such trademark. However, if you lose track of time then do not panic as a reminder notice is issued by the department at least 6 months before the expiry of validity of your trademark. This notice is sent to the registered office address of the owner of the trademark which was mentioned at the time of trademark registration.
How is Trademark Renewal done?
Before the expiry of 10 years validity period of trademark registration you are required to submit a renewal application in Form TM-R. This application is submitted either by the registered trademark holder or you can also appoint an authorized representative to submit it on your behalf.
The applicant of trademark renewal application has a choice at the time of filing an application. They can either apply for the renewal of same trademark without any changes or they have a choice to change it or modify in any manner and then apply for trademark renewal.
